These Terms of Service define the rules for using the SailPlanner Pomerania mobile application, available on the Google Play Store and Apple App Store.</span></p><p><span style=\"color: rgb(0, 0, 0);\">1.2. The application is informational in nature and does not offer the sale of products or services.</span></p><p><br></p><h3><strong style=\"color: rgb(0, 0, 0);\">2. Binding nature of the Terms</strong></h3><p><span style=\"color: rgb(0, 0, 0);\">2.1. Using the Application means that the User accepts these Terms of Service.</span></p><p><span style=\"color: rgb(0, 0, 0);\">2.2. If the User does not accept the Terms, they should discontinue using the application.</span></p><p><br></p><h3><strong style=\"color: rgb(0, 0, 0);\">3. Communication</strong></h3><p><span style=\"color: rgb(0, 0, 0);\">3.1. The Administrator may send the User – with their consent – information related to the use of the application, including notifications regarding water safety (e.g., weather alerts) and important system messages.</span></p><p><br></p><h3><strong style=\"color: rgb(0, 0, 0);\">4. Intellectual property</strong></h3><p><span style=\"color: rgb(0, 0, 0);\">4.1. All materials included in the application (texts, graphics, photos, logos) are legally protected and are the property of the Administrator or its partners.</span></p><p><span style=\"color: rgb(0, 0, 0);\">4.2. The User is not allowed to copy, distribute, or use the application's content without prior consent from the Administrator, unless otherwise provided by law.</span></p><p><br></p><h3><strong style=\"color: rgb(0, 0, 0);\">5. Liability for content</strong></h3><p><span style=\"color: rgb(0, 0, 0);\">5.1. The Administrator makes every effort to ensure that the information in the application is up to date and accurate, but does not guarantee its full currentness.</span></p><p><br></p><h3><strong style=\"color: rgb(0, 0, 0);\">6. Personal data protection</strong></h3><p><span style=\"color: rgb(0, 0, 0);\">6.1. The Administrator processes Users’ personal data in accordance with the GDPR and applicable legal regulations.</span></p><p><span style=\"color: rgb(0, 0, 0);\">6.2. Personal data is processed solely to ensure the proper functioning of the application and is not shared with third parties.</span></p><p><span style=\"color: rgb(0, 0, 0);\">6.4. The User has the right to access their data, correct it, request its deletion, and limit its processing.</span></p><p><span style=\"color: rgb(0, 0, 0);\">6.5. No complaints or returns</strong></h3><p><span style=\"color: rgb(0, 0, 0);\">8.1. Final provisions</strong></h3><p><span style=\"color: rgb(0, 0, 0);\">9.1. The Administrator reserves the right to modify these Terms at any time.</span></p><p><span style=\"color: rgb(0, 0, 0);\">9.2. All changes become effective at the moment they are published in the application or on the website.</span></p><p><span style=\"color: rgb(0, 0, 0);\">9.3.
